Iowa Vape Directory Penalties Expected November 16

Iowa's vape directory penalties are expected to start November 16, 2026, about a month after the state publishes its first list of vapes that stores may sell.

Iowa expects to publish its first vape directory on October 15, 2026 and to start enforcing penalties on November 16, the Iowa Department of Revenue says, calling both dates estimates. Once the list is out, stores may sell only the vapes on it.

The law, House File 2677 of 2024, sat on hold for more than a year until a federal appeals court threw out an injunction against it on July 30, 2026. A store that sells an unlisted vape owes $300 a day for each product, and repeat violations can cost it its permit.

What Iowa's Vape Directory Requires

Iowa's vape directory requires every vapor product sold in the state to be listed, and that includes nicotine-free vape juice and pens. A product qualifies if FDA has authorized it, or if it was on the US market by August 8, 2016 and its maker applied to FDA by September 9, 2020 with no final decision yet. Makers pay $100 a year for each product, and empty tanks, batteries, coils and cases sold on their own don't need to be listed.

Iowa Vape Directory Dates and Penalties

The Iowa vape directory dates and penalties both run from the day the list is published, which the Department of Revenue expects on October 15. Selling unlisted vapes is illegal from that day, but the department will spend the first 21 business days on education, which puts penalties at November 16 by its estimate. Cities and counties can enforce the law too, and the department says their priorities may differ from its own. The department or peace officers can also run unannounced compliance checks.

Under the law, a retailer, distributor or wholesaler that sells or offers an unlisted vape owes $300 a day for each product until it is pulled or listed. A retailer's second violation within two years brings $1,500 or a 30-day permit suspension; a third or fourth within three years, $1,500 plus a 30- or 60-day suspension; and a fifth within four years, revocation. Makers face $1,000 a day per product, and the state can recover its investigation and court costs.

Iowa Vape Directory Court History

The Iowa vape directory's court history began in December 2024, when makers, stores and shoppers led by Iowans for Alternatives to Smoking and Tobacco sued over House File 2677, which had become law on May 17 that year. In May 2025 a federal judge in the Southern District of Iowa blocked the law, finding the challengers likely to win their claim that federal law preempts it.

On July 30, 2026, the Eighth Circuit vacated that order, ruling they were unlikely to succeed. The district court lifted its injunction in early September, and the department reopened sign-ups for makers.
