Pennsylvania starts seizing unlisted vapes from shops on October 19, 2026, and the state's directory still lists only 159 products from six makers.

Pennsylvania can start seizing nicotine vapes that are missing from the Attorney General's directory on October 19, 2026, from any shop or wholesaler that sells, offers or holds them for sale. A first violation costs a shop $500 for every unlisted vape, under Act 57 of 2025.

On October 6 the directory held 159 products from six makers, led by Vuse, JUUL and Naked 100, and no Geek Bar, Raz or Lost Mary. Shoppers face no penalty, and vapes bought for personal use can't be seized. A federal lawsuit by Tobacco Hut store owners is still waiting on a ruling.

What Happens on October 19

What happens on October 19 is the end of the grace period Act 57 gave stores and wholesalers to sell or clear out unlisted nicotine vapes. After October 18, those products may not be bought or sold for retail sale in Pennsylvania, and from October 19 any that are sold, offered or held for sale can be seized. The Attorney General's office says it will not physically remove products before then, and that the date, set by statute, will not change. The rule also covers nicotine-free vapes sold under the same brand name as a nicotine vape.

A first violation costs $500 per product, and each unit counts. A second within 12 months brings $750 to $1,000 per product per day and a license suspension of at least 14 days, and a third brings $1,000 to $1,500 per product per day and revocation (Act 57 text). Which Vapes Are on Pennsylvania's Directory

The vapes on Pennsylvania's directory numbered 159 on October 6, 2026, the same count as October 3, all from six makers. R.J. Reynolds Vapor has 52 (Vuse Alto, Solo and Vibe), Juul Labs 40, Naked 100 e-liquids 40, NJOY 16 (Ace, Daily and Daily Extra), e Cig 4 Inmate 7 and CrossBar 4.

No Geek Bar, Raz or Lost Mary product is listed. The directory page says 22 manufacturer certifications are under review, and the law requires updates at least monthly, so more products could be added before or after October 19.

Where the Tobacco Hut Lawsuit Stands

The Tobacco Hut lawsuit stands without a ruling as of October 6. Companies that run Tobacco Hut stores, a distributor and related businesses sued Attorney General Dave Sunday and Revenue Secretary Patrick Browne in federal court on May 20, 2026, in MMA Group 1 Inc. v. Sunday. In June, Judge Julia K. Munley turned their request to block the law into a motion for summary judgment.

In August she told the stores to address two July 30 appeals court rulings, Vaping360 reported. The Fourth Circuit refused to block North Carolina's directory law, and the Eighth Circuit lifted an injunction against Iowa's. We found no decision since, and the directory page still says the enforcement date has not changed.
